Acceptable use policy

This Acceptable Use Policy sets out the terms between you, the User, and Wunderman Thompson Data ("WTD", "we", "us") under which you may access our website https://absa.cardinal-app.com/auth/login (our "Site") and use our services. This Acceptable Use Policy applies to all users of, and visitors to, our Site as well as to all users of our services.  Your use of our Site and/or our services means that you accept, and agree to abide by, this Acceptable Use Policy.

You may only access our Site if your employer or client (our "Customer") has entered into an agreement with WTD for the provision of our Cardinal campaign code generator services and have designated you as an authorised user. You may only use our Services on behalf of and for the internal business purposes of our Customer. If you are not an authorised user of a WTD Customer, you may not access our Site or use our Services.

Prohibited Use:

You may use our Site and our services only for lawful purposes. You may not use our Site and/or our services:

• To upload, transmit or otherwise process any Personal Information (except if you have been given administrative rights by our Customer, in which case you may upload user email addresses for purposes of creating or editing Users);
• In any way that breaches any applicable local, national or international law or regulation.
• In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
• To access age restricted services if you are below the stated age for accessing such services.
• To circumvent any age restricted service mechanisms.
• For the purpose of harming or attempting to harm minors in any way.
• To send, knowingly receive, upload, download, use or re-use any material which may cause offence.
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
• To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
• To publish, post, distribute or disseminate defamatory, infringing, obscene, indecent or other unlawful material or information.
• To threaten, harass, stalk, abuse, disrupt or otherwise violate the rights (including rights of privacy and publicity) of others.
• To knowingly send, make available or upload files that contain software or other material, data or information not owned by or licensed to you.

You also agree:

• To only use the service in accordance with our Customer agreement with your employer, for our Customer's internal business purposes and for now other purpose.
• Not to reproduce, duplicate, copy or re-sell any part of our Site.
• Not to interrogate or reverse engineer our software or code.
• When accessing the service to only use equipment that is in good working order, properly maintained and compatible with the service.
• To comply with any reasonable instructions given by us concerning your use of the service.
• To co-operate with us in relation to security and other checks.
• That we may collect and process your personal information in accordance with the Site's Privacy Policy https://absa.cardinal-app.com/legal/privacypolicy.
• Not to access without authority, interfere with, damage or disrupt:
  • any part of our Site;
  • any equipment or network on which our Site is stored;
  • any software used in the provision of our Site; or
  • any equipment or network or software owned or used by any third party.

Breach of Acceptable Use Policy

We will determine, in our discretion, whether there has been a breach of this Acceptable Use Policy through your use of our Site and/or our services. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this Acceptable Use Policy constitutes a material breach of the terms on which you are permitted to use our Site and, where you are using our services, a material breach of the terms of your employer's contract with us, and may result in our taking all or any of the following actions:

• Legal. Customers may contact WTD at legal@wundermanthompson.com regarding this Acceptable Use Policy.

We exclude liability for actions taken in response to breaches of this Acceptable Use Policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
